JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Ghanshyampur P.S. Case no. 126 of 2015, registered under Sections 452, 341, 323, 354 and 379/34 of the Indian Penal Code. The accusation is that on 10.06.2015 in the night while informant Gita Jha along with her two children were sleeping in the room at that time petitioner along with two unknown entered in the room and put his hand at the breast of the informant. Thereafter, informant woke up and identified the petitioner in the light of torch and raised alarm then petitioner pressed her mouth. In the meantime, her both children woke up and made alarm then her husband, who was sleeping on the roof, came there and made protest. At that time, this petitioner fled away snatching her golden chain to her neck. Learned counsel for the petitioner submits that petitioner

Patna High Court Cr.Misc. No.54665 of 2017 (2) dt.17-11-2017 2/2 is the nephew of the husband of the informant. Further submission is that, in fact, due to land dispute father of the petitioner has filed Title Suit No. 161 of 2014, which is pending before the Sub-Judge, Benipur, Darbhanga and Dhirendra Jha husband of the informant has also filed the Title Suit No. 47 of 2014. The proceeding of 144 Cr.P.C. was also initiated on the petition of the father of the petitioner on 18.10.2014 due to land dispute suit filed.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM, Biraul, Darbhanga in connection with Ghanshyampur P.S. Case No. 126 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
