JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Triveniganj P.S. Case No. 225 of 2017 registered under Section 366/34 of the Indian Penal Code.

Petitioner along with other accused persons are said to have kidnapped the daughter of the informant. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. As a matter of fact, the victim has eloped with one Mukesh Yadav suo motu. The victim in her earlier statement under Section 161 of Cr.P.C. has sated that she suo motu eloped with Mukesh Yadav. But, in quite contradiction to the aforesaid statement, she has

Patna High Court Cr.Misc. No.52494 of 2017 (3) dt.12-12-2017 stated under Section 164 of Cr.P.C. that she was kidnapped by Mukesh Yadav and petitioner forcibly under the influence of her father. In the said statement she has also admitted the animosity of the petitioner with her father. Petitioner has been languishing in custody since 15.07.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Supaul in connection with Triveniganj P.S. Case No. 225 of 2017.
