2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 366(A) and 34 of the Indian Penal Code.

3. The allegation against the petitioner along with others is of abducting the daughter of the informant, when she went to attend nature's call.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has

The victim girl has been recovered and her statement recorded u/s 164 of the Cr.P.C., in which she stated that this petitioner called her and they both went at Madhepura along with his friends. She further stated that the petitioner told her to bring jewellary from her house (worth of Rs. 2 lacs) and then she went Patna with this petitioner and lived there for about one year. She stated after selling out all the jewellary, the petitioner started to assault her. He submitted that the victim herself fled away from her house with a view to enjoy her life freely after self earning because her arranged marriage has been done by her parents against her wish. He further submitted that the victim went with this petitioner out of her own sweet-will and it seems there was a consensual relationship between both the parties. Petitioner has got no criminal antecedent as stated in para-3 of the bail petition. He is languishing in judicial custody since 26.06.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged

Patna High Court CR. MISC. No.77256 of 2023(3) dt.27-02-2024 3/3 on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria in connection with Gogri P.S. Case No. 66 of 2016.
