2. The petitioner has approached this Court for seeking a direction upon the respondents to consider his claim for extending the benefit of ACP scheme.
3. The claim of the petitioner has been confronted on the strength of Memo No. 6550 dated 17.08.2016, which clearly suggests that ACP scheme is not applicable to the employees of Command Area Development Agency (hereinafter referred to as 'the CADA').
4. Identical issue has come up for consideration
Patna High Court CWJC No.17016 of 2023(2) dt.22-07-2025 2/2 before the learned coordinate Bench of this Court, bearing C.W.J.C. No. 5988 of 2020, which has been dismissed vide order dated 13.12.2021 giving liberty to the petitioners to approach the concerned authority in the event of adoption of ACP/MACP/schemes/rules by CADA, if any.
5. Learned Advocate for the State is present.
