The petitioner seeks bail in connection with Makhdumpur P.S. Case No. 126 of 2005 dated 26.05.2005 instituted for the offences under Sections 304B, 201/34 of the Indian Penal Code.

The petitioner is the mother-in-law of the deceased. The allegation in the F.I.R is that the daughter of the informant viz. Reshmi Devi was married to the son of the petitioner, who, for non-fulfillment of dowry was killed and the dead body was disposed off.

Learned counsel for the petitioner has submitted that an absolutely false case has been lodged by the father of the deceased, knowing fully well that the deceased was not killed at

Patna High Court Cr.Misc. No.56841 of 2017 (4) dt.12-01-2018 2/2 the hands of the accused persons. The petitioner is said to have had such a strong affection for the deceased that after her death, she lost her mental balance and went out of her house and became traceless. Precisely, for this reason, she could not surrender to the process of law. It has further been submitted that the husband of the petitioner, who is father-in-law of the deceased, has been granted bail way back in the year 2008 and the husband of the deceased, being a juvenile, was released on the ground of his juvenility. The petitioner, though was declared an absconder, but she is now in custody since 01.09.2017.

Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Subordinate Judge, IV,/concerned Court, Jehanabad in connection with Makhdumpur P.S.
