The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273, 308/34 of the IPC and Section 30(a), 34 (b), 36 and 41(i) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 30 litres country made liquor and 6.66 litres foreign liquor were recovered from the house of co-accused, Brij Kishore Pandey. It is further contended that nothing was recovered from the conscious possession of the petitioner and petitioner has no connection with the alleged recovered illicit wine. Petitioner claims that he is having clean antecedent and is in custody since 08.07.2018.

No.59310 of 2018(3) dt.06-10-2018 2/2 Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge 2nd -cum- Special Judge, Excise, Siwan in connection with Basantpur P. S. Case No. 218 of 2018.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
