JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-03-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/379/504 and other ancillary sections of the Indian Penal Code and section 138 of the NI Act.

Prosecution case is that on the pretext of sale purchase of land, petitioner cheated Rs.57 lacs of the informant. Cheque issued by the petitioner also bounced due to insufficiency of fund.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He has been made accused in the case only because of being wife of co-accused Anand Shankar Tiwari. petitioner is

Patna High Court CR. MISC. No.73504 of 2022(2) dt.23-03-2023 2/2 none else but sister-in-law of the complainant. Petitioner has not received any amount in her account nor she issued cheques in question.

Considering the fact that petitioner did not receive any amount in her account nor she issued aforesaid cheques, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate V, Danapur in Complaint Case No. 158(c) of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
