2. The petitioners are apprehending arrest in connection with Daniyawan P.S. Case No. 147 of 2020 dated 02.10.2020, lodged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. As per the prosecution, FIR has been lodged against two named accused persons (both the petitioners). Total recovery of 26 litres of desi mahua liquor has been made which is the subject matter of the present case.

4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence.

Patna High Court CR. MISC. No.75645 of 2024(2) dt.11-11-2024 2/2 Counsel submits that only 26 litres of desi mahua liquor has been recovered and nobody was apprehended from the place of occurrence and no offence has made out against the present petitioners. Counsel further submits that the criminal antecedent of the petitioners are clean.

5. Learned APP for the State opposes the prayer for bail of the petitioners and submits that upon the information provided by the local persons and chowkidar, petitioners name has been figured in this case.

6. As such, considering the aforesaid facts and circumstances, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each with two sureties of the like amount each to the satisfaction of the Exclusive Special Court of Excise Act, Patna City in connection with Daniyawan P.S. Case No. 147 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dr. Anshuman, J) Divyansh/- U T
