The petitioner seeks bail in Ara Nawada P. S. Case No. 185 of 2018 instituted for the offence under Section(s) 467, 468, 420 and 120B of the Indian Penal Code.
In the written report, it is alleged that informant who is owner of M/S Maa Laxmi Enterprises had deposited a cheque of Rs. 5,50,000/- drawn on S.B.I. in favour of one Ramasan Prasad in the account maintained with Punjab National Bank as mentioned in the written report and also got the receipt of pay-in-slip in support of the aforesaid deposit of the cheque but the amount was not transferred in the account of Ramasan Prasad. The informant enquired from the Bank then he learnt that the amount has been withdrawn and credited in the account of some other person. During investigation, it came to light that the amount has

No.56786 of 2018(3) dt.30-10-2018 2/2 been transferred in the account of one Sanjay Mandal and thereafter from the account of Sanjay Mandal some amount has been transferred to the account of this petitioner. In such circumstances, it appear from the entire episode that this is a case of serious fraud committed by the petitioner in collusion with the bank officers and other accused person. The investigation is still progressing in this case. The Superintendent of police, Nawada is directed to get investigated seriously the role of bank officials in this episode of fraud because without collusion of the bank officials such type of fraud cannot be done. This Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected at this stage. He is given liberty to renew prayer for bail after six months if no substantial progress is made in the case. Let a copy of this order be communicated to Superintendent of Police, Nawada for taking appropriate action in terms of observation made above.
