The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

From the fodder house of the petitioner 102 liters of liquor was recovered.

Submission is that place of recovery is accessible by any one. No one had seen the petitioner putting the same there. Petitioner has got no criminal antecedent as stated in para-3 of the petition.

Considering the nature of allegation, in my view, this is not a fit case for grant of anticipatory bail to the petitioner.

Patna High Court CR. MISC. No.67762 of 2019(2) dt.18-01-2020 2/2 Prayer for bail is refused in connection with Punaura P.S.Case No.102 of 2019 pending in the Court of ADJ-II-cum-Special Judge, Excise Act, Sitamarhi.

However, the petitioner shall surrender before the court below and the court below shall pass order without being prejudiced by this order.
