The petitioner seeks bail in connection with Barahari P.S. Case No. 27 of 2025 instituted for the offence under Sections 126(2), 115(2), 74, 305, 317(2) & 62 of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in brief, is that on 16.06.202 at about 2:00 A.M., the informant was sleeping when the petitioner entered her house, attempted to steal her mobile, and misbehaved with her. On raising alarm, neighbours arrived, and the petitioner was caught and handed over to the police. 4.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.06.2025. Petitioner

Patna High Court CR. MISC. No.72541 of 2025(3) dt.15-10-2025 2/2 bears one criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case due to previous enmity. From perusal of the FIR itself, it would reveal that prosecution story is manufactured and fabricated. Nothing has been recovered from the conscious possession of the petitioner. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, manner of petitioner's implication and charge sheet being submitted, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Barahari P.S. Case No. 27 of 2025.
