JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-03-2023 The present petition has been filed for restoration of Criminal Miscellaneous Case No.59930 of 2022, which had stood dismissed on account of non-prosecution vide order dated 16.11.2022.

The learned counsel for the petitioner has submitted that the counsel for the petitioner had fallen ill suddenly and therefore, he could not attend the hearing of the case, when the case was called out for hearing on 16.11.2022, thus, a sympathetic view be taken and the aforesaid petition be restored to its original file.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned

No.10431 of 2023(2) dt.15-03-2023 2/2 counsel for the petitioner as also taking into account the averments made in the present petition, I deem it fit and proper to direct for restoration of the aforesaid petition bearing Criminal Miscellaneous No.59930 of 2022 to its original file. The present petition stands allowed.
