The petitioner seeks bail in connection with a case registered for the offence punishable u/s 30(a) of Bihar Prohibition and Excise Act, 2016.

Altogether, 4.5 litres of foreign liquor is said to have been recovered from the spot.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has been implicated in this case due to ulterior motive. No such occurrence, in the manner as alleged has taken place and the whole allegation is concocted. It is further submitted that no incriminating article has been recovered from the conscious physical possession of the petitioner rather the alleged recovery has been made from

Patna High Court CR. MISC. No.71916 of 2025(2) dt.09-10-2025 2/2 outside the house of petitioner. The petitioner has no criminal antecedent and has been languishing in custody since 14.08.2025.

Learned APP for the State opposed the prayer for bail.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court-1, East Champaran, in connection with Sugauli P.S. Case No.436 of 2025.
