The grievance of the petitioner in the present writ petition is non-finalization of the fate of the petitioner although the petitioner is working as Class-III post and similarly circumstances others have been granted the benefit of absorption on class-III post but in the case of the petitioner the respondents are sitting tight.

Mr. Amresh Kumar Singh, learned counsel for the petitioner submits that the writ petition may be disposed of with a direction to the University to take final decision regarding the fate of the petitioner as the petitioner cannot be allowed to discharge the duty on class-III post and denied the benefit of class-III post.

4. In view of the above, the writ petition is disposed of with a direction to the respondent-University to take final decision within a period of 60 days from the date of receipt/production of a copy of this order.

5. If it is found that the petitioner has been legally entitled to be considered for grant of absorption on class-III post, the University will take decision and grant consequential benefits within a further period of two months from the date of such decision.

With the aforesaid, the writ petition stands disposed of.
