The petitioner seeks bail in Shikarpur P.S. Case No. 71/2018, instituted for the offences under Sections 302, 201/34 of the Indian Penal Code.
It is alleged in the written report that when the informant did not find his son in the morning, he raised suspicion and started searching him. In course of search, he reached at wheat field, where he found a huge quantity of wheat plants crushed and earth was brushed clean with water. He found that petitioner and his son were present there. They disclosed that swine has given birth to pigs. The informant seeing the drops of blood on the wheat plants, raised suspicion and on removal of earth, dead body of his
Patna High Court Cr.Misc. No.58497 of 2018 (3) dt.11-10-2018 2/2 son was found lying.
Post-mortem report of the deceased is available with case diary, wherein multiple injuries have been found on the deceased. Cause of death is opined due to shock and haemorrhage caused by multiple injuries.
The petitioner was found on the spot. He was trying to conceal the dead body of son of the informant. The blood stains were found on the earth.
Therefore, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail of petitioner is rejected.
