The petitioner, who is in custody, seeks bail in connection with Sahar P.S. Case No. 54 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code and 25(1-b)a, 26, 35 of Arms Act.

Allegation against petitioner and another coaccused is of snatching mobile phone and Rs. 500 from the informant and thereafter tied his hands and legs and when informant shouted for help then both jumped from running vehicle and subsequently they were caught by police. On search one pistol and a live bullet has been recovered from the possession of petitioner.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.60600 of 2018(3) dt.11-10-2018 2/2 petitioner is quite innocent and has been falsely implicated in this case. There is general and omnibus allegation against petitioner. It has been further submitted that petitioner was labourer and he was going with the petitioner to unload the truck and when he demanded wages then FIR was lodged. Petitioner has no criminal antecedent and he is in custody since 13.03.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Sahar P.S. Case No. 54 of 2018.
