The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.
As per allegation in the FIR, on pistol point, three miscreants entered into Uttar Bihar Gramin Bank, Bhagwanpur and on pistol point looted an amount of Rs. 1,78,176/- from cash counter and cashier of the bank.
It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner has been remanded in this case on the basis of confessional statement of co-accused Manish Kumar Sahni. Neither the
Patna High Court CR. MISC. No.79433 of 2023(2) dt.11-12-2023 2/2 petitioner is named in the FIR not put on TIP. Nothing has been recovered from his conscious possession. Similarly situated other co-accused person has already been granted bail by this Court vide order dated 1.08.2022 passed in Cr. Misc. No. 23377 of 2022. Petitioner is languishing in judicial custody since 4.6.2022.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ADJ 2nd, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 329 of 2019.
