Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 303(2) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner has antecedent of 3 cases, but then one case is of the year 2005 and the second case is under the Excise Act. It is next submitted that informant alleges that the petitioner assaulted him by lathi causing injury on his head, thereafter Umesh assaulted by lathi causing injury on the right elbow, while Kamlesh snatched Rs. 10,000.

The Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that even presuming what has been alleged is true without admitting then the blow was not repeated and the injury suffered by the injured has been opined to be simple in nature, as would manifest from Annexure-3 to the anticipatory bail application. It is further submitted that allegation of snatching Rs.10,000 is ornamental. It is also submitted that the petitioner will not abscond rather will cooperate in the investigation to prove his innocence. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Patahi P.S. Case No. 294 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.

One of the bailors of the petitioner shall be his cousin brother, Sunil Kumar Singh.

However, it is made clear that in the event, if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioner, despite giving assurance to this Court, is not cooperating in the investigation, in that event, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner. 9.
