JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-08-2024 The present writ petition has been filed seeking the following relief:- "1. That the present writ application is being filed for quashing the order dated 05.12.2022 passed by the District Collector, Samastipur in Encroachment Appeal No- 201/2017

Patna High Court CWJC No.17524 of 2023(2) dt.07-08-2024 2/2 and affirming the Final Order dated 14.06.2017 passed by the Anchal Adhikari, Rosera in Encroachment Case No. 09/2016 whereby and whereunder it was declared that the land in question be made encroachment free and necessary action to be taken in this respect."

At the outset, the learned counsel for the petitioners seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioners to avail such other alternative remedies as are otherwise available under the law, including that of filing civil suit before the Ld. Civil Court having competent jurisdiction, for redressal of the aforesaid grievances. Liberty, so sought, is granted.

The writ petition stands disposed off.
