Petitioner, who is in custody, seeks bail in connection with Salkhua P.S. Case No. 99 of 2018 registered for the offences punishable under Sections 25(1-b)A and 26 of the Arms Act.
Allegation against petitioner is recovery of one loaded country made Katta, two live cartridges and nine empty cartridges from his possession.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case due to ulterior motive. Nothing has been recovered from his possession or from his house. There is a land dispute between the parties. He has no criminal
Patna High Court Cr.Misc. No.59952 of 2018(3) dt.26-11-2018 2/2 antecedent and he is in custody since 20.05.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- IV, Saharsa in connection with Salkhua P.S. Case No. 99 of 2018.
