Petitioner, already in custody, seeks bail in connection with Adapur P.S. Case No.169 of 2017 (G.R. No.744 of 2017), registered under Sections 341, 323, 354, 307, 147, 148, 149, 504 and 506 of the Indian Penal Code. Later on Section 302 of the Indian Penal Code has also been added.

Learned counsel for the petitioner submits that there is case and counter case between both sides due to land dispute. The petitioner's father also died during the custody due to the assault and the allegation against the petitioner is of giving a single iron rod blow at the back of the neck but the post-mortem report categorically shows only one swelling injury over the forehead and all family members have been implicated in this case. The

Patna High Court Cr.Misc. No.56992 of 2017 (3) dt.16-01-2018 2 /2 petitioner has no criminal antecedent and he is in custody since 12.06.2017.

Having considered the said facts and circumstances, petitioner Suresh Prasad Shrivastava @ Suresh Prasad is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Motihari, East Champaran in connection with Adapur P.S. Case No.169 of 2017 (G.R. No.744 of 2017).
