2. The petitioner seeks regular bail in connection with Desari (Sahdei O.P.) P.S. Case No. 451 of 2022 registered for the offence under Section 448, 341, 323, 324, 379, 307, 504, 506, 34 IPC.

3. it is alleged that the petitioner and other co-accused persons have assaulted the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He further submits that the petitioner is in custody since 02.09.2022. Similarly situated co-accused persons, namely, Pathal Paswan @ Patthar Paswan has been granted bail

Patna High Court CR. MISC. No.73594 of 2023(3) dt.17-02-2024 2/2 by a co-ordinate Bench of this Court by order dated 16.05.2023 passed in Cr. Misc. No. 17375 of 2023.

5. However, learned APP for the State vehemently opposed the prayer for regular bail.

6. Having heard both the parties, perused the first information report, scertified copy of joint compromise petition and the fact that one of the co-accused has been granted bail, the case of the petitioner is on similar footing and the period of custody, let the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Desari (Sahdei O.P.) P.S. Case No. 451 of 2022.
