The petitioner apprehends his arrest in Kankarbag P.S. case No. 466 of 2016 for the offences punishable under Section 406, 420, 379, 504 of the Indian Penal Code. The informant alleged that petitioner took Rs. 5,600/- for test of C.S.F. of his wife but he issued a receipt of less amount although petitioner took Rs. 5,600/- from the wife of informant. Some verbal altercation took place. The learned counsel for the petitioner submits that informant was Sub Inspector in Patrakar Nagar police station at the relevant time. The petitioner has entered into an agreement with Lal Path Lab. The informant wanted to get the test of blood
Patna High Court Cr.Misc. No.56516 of 2017 (3) dt.02-01-2018 2/2 of his wife free of cost and that is why some altercation took place between the informant and petitioner. The occurrence took place on 27.07.2016 but the written report was given on 29.07.2016. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Smita Rai, learned 1 Judicial Magistrate, 1st class, Patna in connection with Kankarbag P.S. case No. 466 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
