2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 384, 307, 379, 504, 506 of the Indian Penal Code.
3. Prosecution case, in brief, is that on 16.01.2024 at 8:30 AM, informant received an information that petitioner No. 3 was trying to grab the land of informant and when informant reached there then petitioner No. 3 demanded ransom of Rs. 20
Patna High Court CR. MISC. No.78922 of 2024(3) dt.07-01-2025 2/3 lacs. Upon protest, all the accused persons including these petitioners assaulted him with lathi, danda and iron rod. It is further alleged that when brother and son of the informant came to the rescue, they were also assaulted.

Learned counsel for the petitioners submits that assertion of right, title and possession over a piece of land on which the title suit is already pending between the parties vide title suit No. 270 of 2010, a free fight took place between the parties in which both sides sustained injuries. Present case is counter blast of Yogapatti (Nawalpur) P. S. Case No. 26 of 2024 lodged by the petitioners' side against the informant and others. The case lodged by the petitioners is earlier in point of time.
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.
6. Considering the backdrop in which the alleged incident took place and since both parties sustained injuries and case and counter case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like
Patna High Court CR. MISC. No.78922 of 2024(3) dt.07-01-2025 3/3 amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Yogapatti (Nawalpur) P. S. Case No. 30 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
