Petitioner seeks bail in Haspura P.S. Case No.79 of 2018 instituted for the offence under Section(s) 395, 397 Indian Penal Code and 4/5 of the Explosive Substance Act. Counsel for the petitioner submits that petitioner is not named in the First Information Report. As per First Information Report, two persons were apprehended by the police from spot, who disclosed their names as Ravi Kumar and Bindeshwar Singh. Name of this petitioner has come during investigation in the confessional statement of Jai Lal Mahto. The petitioner was put on Test Identification Parade, but brother of the informant did not identify the petitioner.

Patna High Court Cr.Misc. No.56931 of 2018 (3) dt.10-10-2018 2/2 Xerox copy of Test Identification Parade Chart has been produced in the Court at the time of hearing, which may be kept on record.

Petitioner is said to be in custody since 08.05.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Daudnagar, Aurangabad, in connection with Haspura P.S. Case No.79 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
