The petitioner seeks bail in S.Tr. No. 544/2018, arising out of Bhagwan Bazar P.S. Case No. 358/2017, instituted for the offences under Sections 304(B) and 34 of the Indian Penal Code.
Petitioner is the husband of deceased. In the written report, it is alleged that when the informant got information by his Mausa that his Mauseri Sister is ill in her Sasural, he went to her Sasural and found her dead body. It is further alleged that his Mauseri sister was tortured in her Sasural for demand of dowry. She was just married three months prior to the occurrence. Learned counsel for the petitioner has submitted that
Patna High Court Cr.Misc. No.58716 of 2018 (3) dt.29-10-2018 2/2 doctor could not ascertain the cause of death. There is no opinion with regard to cause of death. No FSL report is available in case diary. It is further submitted that in case diary, none of the witness has levelled allegation of committing murder of deceased against this petitioner. Petitioner is in custody since 20.09.2017. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge XIth, Saran at Chapra in connection with S.Tr. No. 544/2018, arising out of Bhagwan Bazar P.S. Case No. 358/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
