This is an application for bail in connection with N.T.P.C. P.S.Case No. 9 of 2017 registered for the offences punishable under Sections 188, 290, 34 of the Indian Penal Code and 30(G) of Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is of recovery of 20 litres of country made liquor and six bottles of Royal Stag, each containing 375 ml. from his motorcycle.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case, nothing has been recovered from his possession and he is in custody for nine months, having no criminal antecedent.

No.55905 of 2017 (2) dt.22-11-2017 2/2 Having heard both sides and considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise)-cum-Additional Sessions Judge-IV, Bhagalpur, in connection with N.T.P.C. P.S.Case No. 9 of 2017, G.R.No. 438 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) If involvement of the petitioner in such type of cases is found in future, his bail bond shall be cancelled.
