JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Roshanganj (Bankey Bazar) P. S. Case No.160 of 2019 disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act.
There is recovery of 600 liters of liquor from a Bolero vehicle and only allegation against the petitioner is that he was also dealing with the liquor business.
Submission of the learned counsel for the petitioner is that the vehicle does not belongs to the petitioner nor any other allegation except that there is confession that he is dealing with the liquor. Considering the same, one of the co-accused has been granted privilege of anticipatory bail, vide order dated 25.09.2019 passed in Criminal Misc. No. 61039 of 2019. Further submission is that petitioner has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge Excise, Gaya, in connection with Roshanganj (Bankey Bazar) P. S. Case No.160 of 2019.
