JUSTICE RAVI RANJAN ORAL ORDER 23-11-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered for offence punishable under Sections 30/30 (a) of Bihar Excise Amendment Act, 2016.

It is contended that, as per allegation, 37.5 liters of foreign liquor was recovered from the house of co-accused Sunil Kumar. It is contended that nothing has been recovered from the possession of the petitioners. Both the petitioners have been apprehended on the allegation that they were engaged in home delivery of alleged liquor. It is urged that the petitioners have remained in custody since 16.09.2017,i.e, for more than two months. It is claimed that their antecedents are clean. No.56022 of 2017(2) dt.23-11-2017 2/2 petitioners, above-named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of 6th Additional District and Sessions Judge-cum-Special Judge, Excise Act, Nalanda at Biharsharif in connection with Sohsarai P.S. Case No. 206/2017 with a condition that if the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
