Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 29.3.2017 passed in Cr. Misc. No.7188 of 2017, on merit.
Submission of the learned counsel for the petitioner is that the petitioner is a lady and she is in custody for more than one year and up till now even the charge has not been framed. Heard learned A.P.P. also.
In this case a report was called for and from perusal of the report, it appears that the case was fixed for framing of charge on 8.12.2017.
Considering the fact that earlier the prayer for bail of the petitioner was rejected on merit, as such I am not inclined to
Patna High Court Cr.Misc. No.56862 of 2017 (3) dt.20-12-2017 2/2 interfere with the earlier order of this Court and as the petitioner is a lady and she is in custody for more than one year, the learned trial court shall expedite the trial and if possible conduct it on day to day basis so that the trial may be concluded within a period of six months.
At the same time, S.P., Kishanganj has to ensure presence of the witnesses in this case in order to get the trial concluded within the period as specified.
With the aforesaid observation, this application is dismissed.
