JUSTICE MADHURESH PRASAD ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

This is a case registered under Sections 302, 201 and 120B of the Indian Penal Code.

The allegations in the FIR made at the instance of the brother of the deceased is that she has been done to death at her matrimonial house in Bombay where she live with her husband. As per the FIR, the death has occurred 12 years after the marriage due to some dispute between the husband and wife as the husband had performed second marriage.

Counsel for the petitioner submits that 9 persons have been made accused from the family of the husband. Petitioner is father-in-law. He is an old man and he has no concerned with the affairs of the husband. No specific allegation has been made against him and that he is in custody since 10.7.2017. He is a man

Considering the aforesaid submissions and the fact that investigation is completed and charge-sheet has been submitted in the instant case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in Tikkari P.S. Case No. 284 of 2017 subject to the conditions :

(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
