Heard learned counsel for the petitioners, Sri Brajesh Sahay; learned A.P.P. for the State, Sri Rajendra Singh and the learned counsel appearing on behalf of the informant, Ms. Surekha.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 115(2), 126(2), 191(2), 308(2), 351(2), 352, 303(2), 109(1), 117(2) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioners submits that petitioners have antecedent of one case and the informant alleges that on 21-7-2025 when he was ploughing his field in the morning when accused persons came and threatened not to plough the field and demanded extortion of Rs. 5 lakh, on protest Bhagirath gave orders to kill, on which Pawan assaulted him by an iron rod causing injury on head, thereafter Kishori, Arvind, Dadan, Sudhanshu and Dinesh assaulted by lathi causing injury on different parts of the body, on alarm when his son, Anmol, came to save him, he was assaulted by Manish, Rajnish and Bhagirath causing fracture of finger of left hand while Arvind snatched his chain.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that on account of dispute relating to land, the occurrence took place, but then it has been falsely alleged that petitioners were demanding extortion. It is further submitted that the land in dispute was earlier purchased by the side of the petitioners; and the informant is the subsequent purchaser, as such an altercation had taken place in which both sides assaulted each other. Patna High Court CR. MISC. No.72468 of 2025(2) dt.12-11-2025 3/3 also submitted the allegation of assault is not specific and the injury suffered by the injured is simple in nature, which amply demonstrates that petitioners never had any intention of committing a serious occurrence.

Learned A.P.P. for the State and the learned counsel appearing on behalf fo the informant opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Ramgarh Chowk P.S. Case No. 139 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
