JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Rajnagar P.S. Case No. 250 of 2017 dated 02.11.2017 instituted for the offences under Section 379 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that his name has transpired during the course of investigation in the confession of one Sato Sahani. Aforesaid Sato Sahani is said to have made statement that he had purchased the stolen motorcycle from the petitioner.
The learned counsel for the petitioner has further submitted that but for the aforesaid statement of the Sato
Patna High Court Cr.Misc. No.63328 of 2018(3) dt.11-12-2018 2/2 Sahani, there is no other material to connect the petitioner with the crime.
With respect to the antecedent of the petitioner, it has been submitted that with respect to the same vehicle, another case has been lodged at the instance of the owner of the vehicle.
Regard being had to the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender within a period of four weeks from today before the learned Court below, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Madhubani in connection with Rajnagar P.S. Case No. 250 of 2017, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
