JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504,34 of the Indian Penal Code.
Petitioner is said to have inflicted spade blow on the head of the informant's husband but admittedly, there is land dispute between the parties and both sides have lodged cases against each other. So far as the injury of the informant's husband is concerned, the impugned order goes to show that the husband of the informant sustained altogether four injuries and one injury was found on his head. However, the doctor opined that the aforesaid injury was serious in nature but the concerned doctor has not stated that injury found on the head of the informant's husband was grievous in nature.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above
Patna High Court CR. MISC. No.70932 of 2019(2) dt.04-12-2019 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Uchakagaon P.S. Case No. 108 of 2015.
