JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-01-2021 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Chandi P.S. Case No. 130 of 2018 (S.T. No. 525 of 2018) for the offence under Section 302 and other allied Sections of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 07.07.2018.

It appears from the report dated 10.01.2020 submitted by the Additional Sessions Judge-IV, Hilsa, Nalanda that the trial of the case is at the final stage, but the trial has not been concluded as yet.

Under the aforesaid circumstances, the court below is directed to conclude the trial in all respect within a period of

No.65664 of 2019(4) dt.22-01-2021 2/2 four months from the date of receipt/production of a copy of this order, failing which the court below shall release the petitioner on bail on appropriate terms and condition and submit a report before the Registrar (Vigilance) of this Court for the failure in conclusion of the trial.
