JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-05-2018 Considering the fate of the case, the learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to approach the respondent Corporation to impress upon the Corporation that according to the Government letter No. 5958 dated 25.4.2012, it has been provided that in case there is no vacancy in the parent department, then the parent department would request another department for accommodating legal heir of the deceased by way of grant of compassionate appointment. Patna High Court CWJC No.17721 of 2017 (3) dt.08-05-2018 2/2 petitioner submits that the said circular of the Government dated 25.4.2012 should be followed by the respondent Corporation. The learned counsel for the Respondent Corporation has submitted that the Corporation has filed a counter affidavit and it has been specifically and categorically stated that there is no vacancy on Class-IV post and since the petitioner is only Intermediate pass, she can only be accommodated on class-IV post.
In view of the aforesaid, the present writ petition is disposed of as withdrawn on the aforesaid terms. (Mohit Kumar Shah, J) BTiwary/- U
