JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2018 Petitioner prays for bail in connection with Sonepur P.S.Case No. 402 of 2018 registered for the offences punishable under Sections 364/34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping of son of the informant and demanding of ransom. Submission of learned counsel for the petitioner is that he has been made accused only on the basis of confessional statement of co-accused and petitioner is in custody since 9.5.2018.
Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail stating that in paragraph 180 of the case diary the victim boy has identified the petitioner and others in TIP.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.61458 of 2018(3) dt.05-11-2018 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner.
This application is, accordingly, dismissed.
