The petitioners apprehend their arrest in Valmikinagar P.S. case No. 47 of 2017 under Section 307 and other Sections of the Indian Penal Code.
The informant, Chhote Gaddi, alleged that the petitioners, Noor Gaddi and Faheem Alam @ Faheem Gaddi assaulted him with spade on his head. Many other persons from the side of informant also got injuries.
The learned counsel for the petitioners submits that there is counter version being Valmikinagar P.S. case No. 46 of 2017. Chhote Gaddi got three injuries, one is on the head, another
Patna High Court Cr.Misc. No.56762 of 2017 (2) dt.18-12-2017 2/2 injury is pain and swelling on left hand wrist and third injury is on left hand wrist. Only one injury, that too simple in nature, was found on the head of informant. both the petitioners sustained injuries on account of assault made by the accused persons of Valmikinagar P.S. case No. 46 of 2017.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri S. Patel, learned Judicial Magistrate, 1st class, Bagaha, West Champaran in connection with Valmikinagar P.S. case No. 47 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
