JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Mehandia P.S. Case no. 66 of 2014, registered under Sections 353, 409 of the Indian Penal Code.

The accusation is that in spite of the direction, the petitioner being the suspended teacher of Upgraded High School, Injore did not hand over the charge of cash book, cheque book to Punyadeo Kumar incharge of the school.

Learned counsel for the petitioner submits that, in fact, informant become incharge of Upgraded High School, Injore after retirement of the Headmaster, Punyadeo Kumar gave an application before District Education Officer about receiving the charge by Md. Khalid Hasan and the order was passed in that regard, but that order

Patna High Court Cr.Misc. No.57142 of 2017 (2) dt.11-12-2017 2/2 was challenged before Patna High Court in C.W.J.C. No. 17349 of 2012 in the meantime, due to non-passing of the proper order in the writ petition, the petitioner handed over the charge to Puynadeo, after succeeding in the writ petition, the petitioner is incharge of Upgraded High School, Injore.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Mehandia P.S. Case No. 66 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
