JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2018 Petitioner prays for bail in connection with Saharsa P.S.Case No. 717 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302, 506 of the Indian Penal Code and Section 27 of the Arms Act. Allegation as per FIR is that petitioner along with other accused persons entered inside the house of the informant and petitioner caught hold of the informant and other accused assaulted the brother of the informant, causing his death. Submission of learned counsel for the petitioner is that there is no allegation of assault against the petitioner to the deceased and there is allegation against the petitioner that he caught hold of the informant and similarly situated co-accused Prem Sagar has been granted bail by a co-ordinate Bench of this

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Saharsa P.S.Case No. 717 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
