JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 This application, for grant of anticipatory bail, arises out of Gwalpara P.S. Case No. 58 of 2018, disclosing offences under Sections 341, 323, 324, 498A of the Indian Penal Code. At the very outset, learned A.P.P. has submitted that in this case charge-sheet has been submitted showing the petitioner as absconder by charge-sheet no. 140/18 dated 31.12.2018, as such, this application for grant of anticipatory bail is not maintainable.

In such view of the mater, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner has to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case,
