Petitioner prays for bail in connection with Narhat P.S.Case No. 118 of 2018 registered for the offence punishable under Section 366 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of daughter of the informant, who is aged 25 years. Submission of learned counsel for the petitioner is that the statement of the victim recorded under Section 164 Cr.P.C. clearly shows that she is a consenting party and moreover no other overt act has been alleged against him and petitioner is in custody for more than five months and charge sheet has been submitted in this case.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.54442 of 2018(3) dt.31-10-2018 2/2 circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Nawada, in connection with Narhat P.S.Case No. 118 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
