2. The petitioner apprehends arrest in connection with Excise (Aurangabad) P.S. Case No. 913 of 2025 dated 01.09.2025, instituted for the offence punishable under Sections 30(a), 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. The allegation is of recovery of 25 litres illicit liquor from a scooty bearing Chesis No.

MD626EG55S1F00167, which belongs to the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that nothing has been recovered

Patna High Court CR. MISC. No.71844 of 2025(2) dt.15-10-2025 2/2 from the conscious possession of the petitioner. There is no independent witness to the alleged occurrence. Lastly, it has been submitted that petitioner has five criminal antecedents.

5. Learned A.P.P. vehemently opposed the prayer for bail of the petitioner and submitted that petitioner is habitual offender and has five criminal cases against him out of which, four criminal cases are of similar nature.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, I am not inclined to grant bail to the petitioner.

7. Accordingly, the prayer for bail of the petitioner is hereby rejected.
