The petitioner seeks bail in connection with Digha P.S. Case No. 282 of 2017 dated 05.09.2017 instituted for the offences under Sections 114, 115, 144, 145, 146, 147, 148, 149, 186, 307, 323, 332, 333, 336, 337, 338, 342, 353, 395, 397, 427, 504 of the India Penal Code and Section 27 of the Arms Act. Though the petitioner has been named in the F.I.R but the allegation is that he along with many others assembled/congregated at the place of occurrence and damaged the property.
Learned counsel for the petitioner submits that no specific allegation has been levelled against him and other persons, similarly situated, have been granted bail by different
Patna High Court Cr.Misc. No.57304 of 2017 (2) dt.04-12-2017 2/2 Benches of this Court. The petitioner is in custody since 06.09.2017 and is an accused only in one case apart from the present case.
Regard being had to the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Patna in connection with Digha P.S.
