JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2018 Petitioner prays for bail in connection with Andhrathadhi P.S.Case No. 57 of 2015, corresponding to G.R.No. 803 of 2015, registered for the offences punishable under Sections 396 and 397 of the Indian Penal Code. Allegation as per FIR is of committing dacoity and in course of dacoity one lady was killed.

Submission of learned counsel for the petitioner is that except confessional statement of co-accused there is nothing against him and there is no recovery from his possession and he has not been put on T.I. Parade and he is in custody for seven months.

Heard learned APP also and on perusal of record it appears that petitioner is accused in 10 other cases. Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.62723 of 2018(3) dt.26-11-2018 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner.

However, once charge has been framed in this case, petitioner may renew his prayer for bail before the court below, which shall be considered on the basis of materials available on record at that time.

With the above observation, this application is dismissed.
