JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-12-2019 The petitioner, who is in custody since 12.07.2019, seeks bail in connection with Jogbani P.S. Case No. 159 of 2019 which has been instituted for the offences under Sections 341, 323, 324, 307, 379, 34 of the Indian Penal Code.

The petitioner has been projected as a friend of one of the co-accused persons viz. Deepak Yadav. The allegation in the F.I.R is that all the three persons took the informant to a particular destination and asked him to hand over the motorcycle. On refusal, the informant is said to have been assaulted by Deepak Yadav.

The injuries suffered by the informant are

Considering the nature of accusation against the petitioner and the background facts as well as the period of his custody, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Araria in connection with Jogbani P.S. Case No. 159 of 2019. Before having said that, the Court also took note of the fact that the other case in which the petitioner has been made accused was instituted after the remand of the petitioner in this case.
