Petitioner seeks bail in K.Nagar (Srinagar) P.S. Case No. 290/2018, registered for the offence punishable under Section 306 of the Indian Penal Code.
Informant alleged that on 29.07.2018 he received information on mobile that his sister consumed poison on account of altercation in between his sister and her brother-in-law (Bhaisur) due to land dispute. Informant went to his sister's house and saw that her dead-body was lying on a cot and all the family members had absconded.
It has been submitted that petitioner has falsely been implicated in this case. Petitioner is brother-in-law (Bhaisur) of the deceased who is living separately. He has no concern with the
Patna High Court Cr.Misc. No.64545 of 2018 (3) dt.05-11-2018 family affairs of the deceased. He has no land. Therefore, there is no question of land dispute.
Petitioner has no criminal antecedent. He is in custody since 31.07.2018.
Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with K. Nagar (Srinagar) P.S. Case No. 290/2018, subject to the conditions:
(1.) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2.) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court.
(3.) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
