The petitioner is in custody since 21.12.2018 in connection with Chhatapur P.S. Case No. 127/2018 registered for the offence punishable under Sections 366A/120B/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation is false and fabricated and the petitioner and the victim girl have married and living together. However, it appears from the records of the case that the petitioner had earlier raped the victim girl for which a case had been instituted, but in the said case, he had been granted bail. It is further submitted by learned counsel for the petitioner that the second case is one of false implication.

However, the victim girl in her statement made

Patna High Court CR. MISC. No.67945 of 2019(2) dt.18-11-2019 2/2 under Section 164 Cr. P.C. has submitted that she had been kidnapped and her age appears to be only 14 years. Considering the aforementioned facts and circumstances, I am not inclined to grant regular bail to this petitioner.

It is, accordingly, rejected.

Let the trial of the case be expedited so as to conclude the same positively within a period six months from the date of receipt/production of a copy of this order. (Anjana Mishra, J) Saif/- U T
