2. This modification application has been filed for extension of time to surrender before the court below in term of the order dated 26.06.2024 passed in Criminal Miscellaneous No. 35955 of 2024 and order dated 13.09.2024 passed in Criminal Miscellaneous No. 63881 of 2024 by this Court.
3. Learned counsel for the petitioners submits that vide order dated 26.06.2024 and 13.09.2024, petitioners were granted bail and six weeks' time was granted to the petitioner to surrender before the lower court, since another case bearing Rupaspur P.S. Case No. 716 of 2023 has been lodged against the
Patna High Court CR. MISC. No.78297 of 2024(2) dt.29-11-2024 2/2 petitioners so in view of apprehension of arrest they could not surrender before the lower court within time fixed by this Court. Now the petitioner has been granted bail in Rupaspur P.S. Case No. 716 of 2023. As such, learned counsel for the petitioner prays for extension of time to surrender the petitioners before the lower court.
4. Considering the aforesaid facts and circumstances and averments made in the application, this modification application is allowed.
5. Four weeks' further time from today is granted to the petitioner to surrender before the court below in terms of the order dated 26.06.2024 passed in Criminal Miscellaneous No. 35955 of 2024 and order dated 13.09.2024 passed in Criminal Miscellaneous No. 63881 of 2024 by this Court.
6. The Order dated 26.06.2024 passed in Criminal Miscellaneous No. 35955 of 2024 and order dated 13.09.2024 passed in Criminal Miscellaneous No. 63881 of 2024 by this Court stands modified to the aforesaid extent. (Khatim Reza, J) Sankalp/- U T
