ANJANA MISHRA ORAL ORDER 14-12-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 21.07.2018 in connection with Pachrukhi P.S. Case No.233 of 2014, (S.Tr. No. 283 of 2015) registered for the offence under Sections 326(A)/307 of the Indian Penal Code.
Learned counsel for the petitioner submits that the prayer of the regular bail was earlier rejected in Cr.Misc. No.41211 of 2014 vide order dated 24.11.2014 in connection with misuse of the privilege of bail which was earlier granted to him.
Learned counsel for the petitioner submits that due to circumstances the petitioner could not present himself before the court and the bail bond cancelled and he was taken
Patna High Court Cr.Misc. No.70563 of 2018(2) dt.14-12-2018 2/2 into custody. Learned counsel for the petitioner indicates that he shall be present at all dates before the court without any delay in the process of trial.
Considering the aforementioned fact and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cum-Special Judge, Excise, Siwan, in connection with Pachrukhi P.S. Case No.233 of 2014 (S.Tr. No. 283 of 2015). One of the bailors will be his father. It is made clear that the petitioner does not present himself in court on each and every date during trial and in the event of his failure on two consecutive dates his bail bonds shall be cancelled automatically.
